This agreement governs the general purchasing conditions for the different products and services offered on this webpage by RAM NARAYAN SL (hereinafter, RAM NARAYAN) holder of NIF nº B63360358 and resident at C/Boqueria, 25, local 2, 08002, Barcelona (Spain).
The CLIENT acknowledges sufficient legal capacity to be contractually bound.
This contract is available at all times in the legal notices on our webpage.
1. PRICES AND TAXES
In consideration for the product acquired, the CLIENT expressly accepts to pay to RAM NARAYAN at the time of purchase the sums specified on the price list shown on the website www.platayminerales.com for the chosen products.
All products offered on this website are subject to Value Added Tax (VAT). The price shown for each product do NOT include VAT.
Delivery of the items shall be deemed to take place in the VAT applicable territory when the delivery address is located in Spanish territory, except Canary Islands, Ceuta and Melilla. The applicable VAT rate will be that legally in effect at the time in accordance with the specific item in question. Deliveries of orders shipped to the Canary Islands, Ceuta, Melilla are VAT-exempt, without prejudice to the relevant taxes and tariffs being levied under the law in effect in each of these territories.
For shipments to European Union countries, Spanish VAT will be deducted and the VAT rate of the country of destination will apply.
Any import and/or customs duties applicable shall be borne by the recipient. These expenses may vary depending on the country of destination and therefore cannot be estimated prior to delivery in most cases.
Shipping costs are NOT included in the price of the products.
Shipping will be free of charge for orders to the Iberian Peninsula for purchases in excess of 200 euros + VAT.
Once the products have been selected and before the order is confirmed and payment made, the final purchase price will appear on the screen, which includes the VAT (Value Added Tax), handling, packaging and shipping expenses, if any, which will be shown on the purchase order at the time of purchase and on the bill.
It does not include any item not specified as included in the description.
2. PURCHASING PROCEDURE
This webpage may only be used to place orders by professional companies and the self-employed.
The webpage describes all our products individually. The procedure for making and handling the purchase is shown on the webpage, just by following the steps below:
a) Create an account as a new client by completing a registration form with your personal and professional data and creating a personal account as a user. Following this step, you will receive an email confirming that your registration is successful and that you can start to select products and make purchases. The user code and password are personal and belong to the person who registered, who shall be solely liable for their safekeeping. You can manage the information we possess and modify or update your data via your account. If you are already a registered user, just enter the username and password you created to start the purchasing process.
b) Choose the desired product and amount.
c) When you select a product it can be added to the Shopping Cart and you can then continue shopping or process the order.
d) The order showing the articles selected one by one will then be checked and the total price calculated. You can include the code of a discount coupon, if any.
e) You will need to give a billing address for the item purchased and specify whether the order will be collected at the shop or is for home delivery. A single address may be given for both billing and delivery.
f) Once this process is complete, it is necessary to check the box indicating that the terms and conditions of sale have been read and accepted and press the “Submit Order” button.
g) The screen will then show the systems provided for making payment.
h) You must then confirm the order by pressing the “Submit Order” button.
i) After pressing the “Submit Order” button you will receive an email confirming the purchase and indications on the delivery of the product.
The CLIENT is aware that the photographs and descriptions of the products on the webpage are an approximate image of the products offered and that they may differ from the original. The descriptions and illustrations of the products offered on this webpage are solely for information purposes.
3. AVAILABILITY AND DELIVERY
The products offered by RAM NARAYAN are available for distribution anywhere in the world.
Orders will be processed once payment is received correctly.
The products offered by RAM NARAYAN are always subject to availability, as specified on our Website for each product. Should any item not be available, the client will be duly informed of this lack of availability. Under normal conditions, all the products appearing on our Website are available for delivery within the timeframes shown.
When a product is out of stock after being ordered by the CLIENT, they will be duly informed and offered an alternative product with similar characteristics in terms of price and quality to the one purchased. If the CLIENT is not interested in accepting the alternative, RAM NARAYAN shall return any sums paid and inform them of the steps and deadlines for reimbursement.
As a general rule, the maximum time to collecting the product at the shop or for home delivery will be 24 hours from the time of purchase and confirmation of payment. These delivery times are approximate and under no circumstance are binding upon RAM NARAYAN.
Deliveries are made on workdays (Monday to Friday). The CLIENT is advised to indicate their time preferences for delivery in the Comments section when filling in the details of their order .
If you have chosen home delivery, this will be carried out by the carrier together with a delivery note for the address given on the purchase order which the client must sign as an acknowledgement of receipt. In addition, the CLIENT will be duly advised if any incident occurs or if delivery is delayed for any reason.
Should delivery to the address given not be possible due to the recipient’s absence, the carrier will directly contact the CLIENT with details on how to proceed. Should delivery be impossible due to an incorrect address being given, the cost of re-shipping the order will be borne by the CLIENT. RAM NARAYAN is not liable for any delay in deliveries of items purchased when the cause is attributable to the carrier.
To keep the CLIENT informed at all times of the handling of the purchase, they will receive an email confirming the order and payment.
The CLIENT may also consult the status of their order on our webpage by going to their client account.
4. PAYMENT AND PAYMENT PERIODS
The following forms of payment are accepted:
- Bank transfer: by depositing the total amount of the purchase in the current account shown.
Once payment is made you will receive a confirmation email.
Payments are prior to delivery of the product and therefore RAM NARAYAN will not supply the product ordered until such time as it has received payment of same. RAM NARAYAN reserves the right to temporarily or definitively cancel any orders placed due to any incident relating to collection of payment.
Upon making payment, if the CLIENT wishes, they will receive the Invoice for the purchase in PDF format via the email address have provided when processing the order. The original will be delivered together with the product purchased at the time of delivery.
The CLIENT is responsible for confirming receipt of any notifications and informing us of any modification to their details, and RAM NARAYAN will accept no liability due to this circumstance.
All our products are subject to quality controls and are warranted against faulty manufacture for a 2-year period as from the date of purchase. The warranty covers any defect in manufacture, design or materials, although you must report non-acceptance within a period of 2 months as from becoming aware of same.
The warranty only covers faulty products. It does not cover blows, improper use or any others not attributable to a supplier or product defect. During the warranty period the CLIENT may return the product and we will repair or replace it. Shipping costs due to items returned during the warranty period will NOT be borne by the CLIENT.
The warranty document is the purchase receipt.
The following conditions for returning our products shall not apply to cases where the right of withdrawal is exercised.
Product returns or changes will only be accepted in the case of manufacturing defects, damage during shipping or delivery errors. Under no circumstance may more than 30 days have elapsed from receipt of the product. The packaging and accessories must be included. Prior to acceptance, the existence of defects or anomalies in the manufacturing or packaging, together with inadequate or negligent use, handling or storage will be verified. Products must always be accompanied by the relevant delivery note or bill.
If an item is returned due to a manufacturing or packaging defect or any error in the order, the CLIENT will be offered, if possible, the repair of the item or a its replacement by an alternative at no additional cost and without any right to compensation on the part of the CLIENT. Expenses arising from shipping a repaired or correct order will be borne by RAM NARAYAN.
In any event, the return will be subject to RAM NARAYAN first examining the condition of the product returned and verifying that the requisites necessary under these conditions of sale have been complied with. Once the return has been received and if applicable, we will refund the sum paid within a maximum of 30 days and under the same terms as used for making payment.
RAM NARAYAN reserves the right to reject returns reported or shipped after the deadline or any products not in the same condition as when received.
Returns will be managed by sending an email to email@example.com describing the reasons and causes alleged for the return. It is also necessary to include the name and surnames and reference number of the order. Once the request has been received, we shall process it accordingly.
8. PERFECTION OF THE CONTRACT AND MODIFICATION OF SERVICES
This contract is perfected by payment of the product and shipping to the CLIENT with a confirmation email containing a description of the purchase.
RAM NARAYAN reserves the right to modify in any manner any of the characteristics and conditions of its services to improve them and benefit the CLIENT.
9. OBLIGATIONS OF THE PARTIES
RAM NARAYAN undertakes to supply the CLIENT with the products and services acquired, using due diligence in providing the service and safeguarding the necessary facilities for operation of the network, for which purpose it has adequate technical and IT equipment and to manage the logistics, shipping and delivery of the purchase by means of the forwarder.
The CLIENT undertakes to use the services at their disposal in good faith without infringing any laws or third-party rights and to pay for the product selected in the manner and at the time set forth in these sales conditions and upon receipt at the place indicated for delivery.
RAM NARAYAN does not warrant that the availability of the service referred to herein is continuous or uninterrupted due to circumstances originating as a result of Internet issues, breakdown of IT devices or other unforeseeable circumstances. The CLIENT therefore accepts to tolerate these circumstances within reasonable limits and expressly waives any claim against RAM NARAYAN for any contractual or extra-contractual liability for any failures, errors or use of the service engaged.
All and any notices between the parties shall be preferably via email. The CLIENT is responsible for confirming receipt of any notices and informing RAM NARAYAN of any modification to their details, and the latter shall not bear any liability arising from this circumstance. In the event of a modification, the CLIENT must inform RAM NARAYAN by email or by calling the telephone numbers appearing on our webpage.
Pursuant to article 21 of Law 34/2002 on Information Society and Ecommerce Services we inform you that are commercial communications and information relating to our website and the products offered there will be carried out by email to the address provided, which will be revocable. You have in any event the option of rejecting our commercial communications by sending an email to firstname.lastname@example.org with the subject line UNSUBSCRIBE.
11. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT
The CLIENT acknowledges they have understood all the information regarding the products and services including, if applicable, those of delivery as presented on our webpage together with all the conditions and stipulations contained herein and attests that they are sufficient to exclude any error in consenting hereto and therefore expressly accepts same in full.
The CLIENT is fully aware that the acceptance and execution of this contract shall take place by providing their data and by pressing the “Purchase” button on our webpage and perfected by payment of the service.
12. APPLICABLE LAW
This contract is commercial in nature and shall be governed and construed pursuant to Spanish law.
Should any type of discrepancy or dispute arise between the parties as to the construction, content or execution hereof which cannot be resolved by mutual agreement, the Parties shall submit to the competent courts.
